As the nation debates the issue of “due process” for 12 million illegals imported by the Biden administration, we’re not discussing a key question:
What are these immigration judges smoking?
A quick hit in regard to the case making all the headlines, in which the Trump administration committed the cardinal sin of deporting a gangster to the wrong country:
Congress has to get on this. We cannot continue to expand “due process” to the point that every b.s. asylum claim results in endless procedural impediments while criminals remain on our streets. Not when we just imported 12 million new bodies.
Are they all perps? Of course not. But do the math. If even 1% are criminals — likely an underestimation — that would mean we just paid to import 120,000 predators who will target our citizens and clog our criminal justice system.
This is untenable. Congress needs to act to create expedited removal processes. Every deportation can’t result in restrictions, hearings, appeals, and bleeding-heart protests. We can’t do this for the next four years (or longer).
Short of that: ship them all to California.
Elections Do Indeed Have Consequences
Remember when Obama said that? Right he was.
First we were told that the southern border COULDN’T be secured without an act of Congress. Funny how fast that changed (actually, not so funny).
Then, as I lamented ad nauseum on-air during the latter Biden years, not one major conspiracy or RICO case was brought by the feds against the Venezuelan prison gang Tren de Aragua. Not one. Likely due to the tacit admission of responsibility that any such case would entail from the Biden administration.
But now this, via Reuters:
Hats off to DOJ, DHS, and NYPD for this, the first federal RICO against TdA that I am aware of. (Here’s the press release).
THIS is how you have to do it. This is how you flip guys, dump phones for connectivity, develop assets, etc. This is how you map the network.
You know — police work.
Remember when the feds actually did that?
Fortunately, someone finally has.
Good Work, With Complications
This was a term we often used back when I was still working cases. (The other favorite phrase: “No good case goes unpunished”).
Here’s why it might apply today. Attorney General Pam Bondi just announced another new development re: Tren de Aragua — the charging of a high-ranking TdA member on terrorism charges. Bringing, potentially, the death penalty.

Here’s the issue. While President Trump did indeed designate TdA, MS-13, and the Mexican cartels as terrorist groups, it’s not certain that that designation — which has yet to be challenged — will hold up.
Under federal law, “terrorism” is defined as,
Violent acts that appear intended to:
Intimidate or coerce a civilian population;
Influence government policy through intimidation or coercion;
Affect the conduct of a government by mass destruction, assassination, or kidnapping.
In other words, violence + an ideological motive.
Now, this space is certainly not interested in defending TdA. But will the notion that they’re “terrorists” under the above definition hold up?
The likeliest avenue for the government here is the first bullet: “Intimidate or coerce a civilian population” (my emphasis). The idea being, TdA “intimidates” the civilian population that they prey upon.
Will it be enough? Because the defense here will almost certainly use this case to initiate the first challenge to President Trump’s “terrorist” designation — by claiming that TdA operates from the profit motive, not ideology.
Uncharted waters. Expect battle-lines drawn between the usual camps.
Karen Read Redux
So the retrial of Karen Read has kicked off. Quite the whodunit, but we should not lose sight of one thing: a man — a very good man, by all accounts — is dead before his time.

Nobody knows the Read case and the atmospherics up there better than this guy. You’ve got to hear him.

As the Democrats continue to flail about in search of a message and a direction, their latest “savior” is Illinois Governor J.B. Pritzker. Politico just ran a puff piece on him that is to journalism what Alvin Bragg is to law enforcement.
But let’s remember something. Aside from his hyper-left positions on the border, men in women’s sports, etc: this is the guy who signed the SAFE-T Act, which instituted statewide in Illinois the “brilliant” criminal justice reforms that have taken New York City back to the 1970’s.
And whose flagship city is Chicago.
Dems: J.B. Pritzker is not the answer — and has no answers.

I think it’s clever that the DoJ is using RICO agains gangs. However, it does point out how laws have unintended consequences beyond what the lawmakers had as their original intent. I hate that government creep is unstoppable…
